I was contacted by a reporter from the national Pluribus News to opine on a piece of legislation that is going to be introduced to the Florida Legislature in their next round (we blogged about it HERE). Essentially HB657 seeks to “establish for the first time, a clear legal framework for terminating a homeowners association when it becomes dysfunctional and no longer serves the community’s interests.”  Clearly the author of the bill, Florida Rep. Juan Carlos Porras, is not a fan of HOAs and wants them to be easily extinguished.

As we discussed in our blog, the bill requires just 20% of homeowners to force a board to hold a vote to “wind down operations” if said homeowners signed a petition. That’s a mighty small minority to get the legal engine running to terminate the life of an HOA. Even with a two-thirds vote requirement to enact the plan by homeowners, the 20% minority can certainly make your life as a board member ever more miserable.

I made that point with the reporter and he covered the story this morning on Pluribus News, which covers news from all 50 legislatures in the country. He kindly sent me the story so I could post it below, rather than having to pay the $2,250 fee for entry (it’s free for legislators and staff members, of which I am neither.). Enjoy below.
