It turned out to be a Trail of Trouble for a North Carolina HOA that was recently pitted against a homeowner who literally started destroying the entrance to a walking trail on the HOA’s property.
The dispute started some years ago when the city of Cary apparently gave the homeowner, who owns two properties near the trail, some sort of easement control to do whatever he wanted with the trail.
The HOA disagreed when homeowner Keith Myers made the trail his own in an unusual way. According to WRAL-TV in Raleigh, Myers took matters, and a jackhammer, into his own hands:
In an attempt to keep his neighbors and others from using the path between his two properties, he had placed concrete bollards on the trail and tore it up with the jackhammer.

The HOA sued and it went to court.
Last week, Superior Court Judge Paul C. Ridgeway ruled in favor of the HOA, saying that both Myers are prohibited from “damaging, obstructing or interfering” with the association or its’ members’ use of the easement.
The court also ruled the homeowner needed to pay more $21K in damages.
